Crow's Nest Terms of Service

These terms are a contract between you and Ethan Duval ("Crow's Nest," "we," "us") governing your use of the Crow's Nest app and website (the "Service"). By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.

We have kept these terms as short and readable as we can while still saying what needs saying.

1. The Service

Crow's Nest is a wishlist app: you create lists of things you want, organize them, and optionally share them with people you choose. Sharing features include connections, shared lists with view or edit permissions, and gift claiming with a surprise mode. The Service is currently provided free of charge.

2. Your account

You must be at least 13 years old (or the higher minimum age of digital consent in your jurisdiction) to use the Service. You are responsible for your account credentials and for activity on your account. Provide accurate information and keep your email current, since it is how you recover your account and how we reach you.

You may delete your account at any time in the app's settings. Deletion is immediate and permanent.

3. Your content

You keep ownership of everything you add to Crow's Nest: your lists, items, notes, and photos ("Your Content").

So that the Service can function, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display Your Content solely for the purposes of operating, providing, and improving the Service, including displaying it to people you have shared it with and scanning images through our automated moderation systems. This license ends when you delete the content or your account, except for residual copies in routine backups for a limited period and records we must retain by law.

You are responsible for Your Content. Only upload content you have the right to use.

4. Acceptable use

You agree not to use the Service to:

Upload content that is unlawful, or that depicts or promotes the sexual exploitation of anyone, especially minors. Content of this kind is reported to the authorities as required by law. Upload pornographic or sexually explicit content. Crow's Nest is not the place for it; product photos of items like swimwear or lingerie are fine. Harass, threaten, impersonate, or defraud anyone. Upload malware, attempt to breach or probe our systems, scrape the Service, or interfere with its operation. Circumvent access controls, moderation systems, or another user's privacy settings. Use the Service to spam, or create accounts by automated means.

We may remove content or suspend or terminate accounts that violate these terms. For serious violations we may do so without prior warning. Where reasonable, we will tell you what happened and give you a way to respond.

5. Moderation, reporting, and blocking

Uploaded images are automatically scanned before they become visible to other users, as described in our Privacy Policy. Images that violate section 4 are blocked. You can report items and block other users in the app; blocking removes the connection between you and prevents them from contacting you through the Service.

If you believe your content was blocked in error, contact us at support@getcrowsnest.app and we will review it.

If we obtain actual knowledge of child sexual abuse material, we will report it to the National Center for Missing & Exploited Children and preserve related records as required by United States law.

6. Sharing, claims, and surprises

When you share a list, the people you share with can see its contents according to the permission you grant (view or edit), and editors can add and modify items. Think before you share; we cannot control what people you have granted access to do with information they can see (such as telling someone what is on your list).

Gift claims are a coordination convenience, not a promise. A claim does not obligate anyone to buy anything, and we are not a party to any purchase. Surprise mode hides claim details from list owners as described in the app; do not rely on it for anything more important than gift surprises.

7. Third-party stores and links

Items in Crow's Nest often link to third-party stores. Those stores are not affiliated with us. Purchases you make are between you and the store, under the store's terms. We are not responsible for third-party sites, prices shown in the app (which may be out of date), or the availability or quality of any product.

If we introduce affiliate links in the future, we will disclose it clearly in the app. An affiliate link never carries your personal information.

8. The Service is provided "as is"

We work hard on Crow's Nest, but it is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that data will never be lost. Keep copies of anything irreplaceable.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or gift-giving outcomes, arising out of or relating to the Service. To the maximum extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of fifty US dollars (US$50) or the amount you paid us in the twelve months before the claim arose.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these terms limits liability that cannot lawfully be limited.

10. Indemnity

If a third party brings a claim against us arising from Your Content or your violation of these terms, you agree to indemnify us against that claim, including reasonable legal fees.

11. Apple App Store terms

If you use Crow's Nest on an Apple device: these terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance for the app, is not responsible for addressing any claims relating to the app, and is a third-party beneficiary of these terms with the right to enforce them against you. You represent that you are not located in a country subject to a US government embargo and are not on any US government restricted-party list.

12. Changes

We may update the Service over time, adding, changing, or removing features. We may also update these terms. If a change is material, we will notify you in the app before it takes effect, and your continued use after that constitutes acceptance. If you do not agree to updated terms, stop using the Service and delete your account.

13. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these terms, if required by law, or if we discontinue the Service (in which case we will give reasonable notice where practicable). Sections that by their nature should survive termination (including 3, 8, 9, 10, and 14) survive.

14. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-law rules. Disputes will be resolved in the courts of the Commonwealth of Virginia, USA, and both sides consent to that venue. Before filing anything, please contact us at support@getcrowsnest.app; most problems can be fixed faster with an email than a lawsuit.

15. Miscellany

These terms and the Privacy Policy are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of the Service, and will notify you if that happens.
